It is Ordered and Notice is given that on November 15, 2013 at 8:45 a.m., a hearing will be held in this Court at St. Cloud, Minnesota, on a petition for the formal probate of an instrument purporting to be the decedent’s Will dated July 12, 2010 and for the appointment of Edna I. Otte whose address is 39298 COUNTY ROAD 185, SAUK CENTRE MN 56378, as personal representative of the decedent’s estate in an unsupervised administration.

Any objections to the petition must be raised at the hearing or filed with the Court prior to the hearing. If the petition is proper and no objections are filed or raised, the personal representative will be appointed with the full power to administer the decedent’s estate, including the power to collect all assets; pay all legal debts, claims, taxes, and expenses; sell real and personal property; and do all necessary acts for the decedent’s estate. 

Notice is further given that, subject to Minn. Stat. § 524.3-801, all creditors having claims against the decedent’s estate are required to present the claims to the personal representative or to the Court within four (4) months after the date of this notice or the claims will be barred.

Project: Stearns County Ditch 26 (CD 26) Repairs- Phase I

1.1 NOTICE TO CONTRACTORS

Sealed Bid Proposals for the furnishing of all labor, materials and all other items necessary to complete the work described herewith, will be received by Sauk River Watershed District at its office located at 524 4th St. S, Sauk Centre, MN, until 11:00 AM, November 18, 2013, at which time such bids will be opened and read aloud.  The work, in accordance with drawings and specifications prepared by Wenck Associates, Inc. consists of approximately the following major items of work:

Tree clearing 

24,270 LF of ditch cleaning including excavation, grubbing, vegetation removal, and disposal of materials

11,720 LF of ditch cleaning including vegetation and brush removal only

450 CY of Class II Riprap at existing drain tile outlets as directed by Engineer (including geotextile underlayment)

128 LF of culvert remove and replace (diameter varies; RCP w/ flared end sections)

Remove and replace 25 LF 60 inch RCP

Approximately 80 CY of Class III riprap (including geotextile underlayment)

Installation of up to 8 low flow crossings

Buffer establishment, site restoration and erosion control

Approximately 2,750 LF ditch side slope reshaping

Bid Proposals shall be submitted on forms furnished for that purpose.

Each bid proposal shall be accompanied by a “Bid Security” in the form of a certified or cashier’s check made payable to Sauk River Watershed District (“OWNER”) in an amount not less than five percent (5%) of the total bid, or a surety bond in the same amount, running to the OWNER, with a surety company duly authorized to do business in the state of Minnesota, such Bid Security to be a guarantee that the bidder, if awarded a contract, will enter into a contract with Sauk River Watershed District; and the amount of the certified check will be retained or the bond enforced by the OWNER in case the bidder fails to do so.  The OWNER will retain the deposits for the three lowest bidders until the contract has been awarded and executed but not longer than sixty (60) days.  No bid may be withdrawn for a period of sixty (60) days following the bid opening.

A PRE-BID meeting will be held November 6, 2013 at 11:00 AM at the Sauk River Watershed District office located at 524 4th St. S, Sauk Centre, MN.  The project is located on privately owned land with an access easement.  ACCESS TO THE SITE SHALL BE ARRANGED SOLELY THROUGH THE SAUK RIVER WATERSHED DISTRICT BETWEEN NOVEMBER 6, 2013 and NOVEMBER 18, 2013. 

The bid of the lowest responsible bidder is intended to be accepted on or before the expiration of sixty (60) days after the date of the opening of bids.  The OWNER, however, reserves the right to reject any or all bids and to wave any minor irregularities, informalities or discrepancies, and further reserves the right to award the contract in the best interest of Sauk River Watershed District.
