NOTICE IS HEREBY GIVEN that the Managers of the Sauk River Watershed District, Drainage Authority for Stearns County Ditch (CD) 51, will hold a final hearing on a petition to improve a portion of CD 51 pursuant to Minnesota Statue 103E.341 on November 21, 2013 at 7:10 P.M. at the Sauk River Watershed District office located at 524 Fourth Street South in Sauk Centre, Minnesota.

The petitioned improvement seeks to convert approximately 700 feet of open ditch at the top of the drainage system to buried tile. A final engineer’s report has been filed for the project. Because the project is occurring on and for the benefit of a single property and the owner has consented to benefits and damages and will pay all costs, no viewing was required for the project and no viewer’s report is filed. The project is located in the NE 1/4 of Section 5 of Raymond Township (T125N R35W), Stearns County, Minnesota. And affects property owned by the petitioners Kenneth H. and Julie A. Zimmerman.

The Stearns County Board of Commissioners is seeking applicants for an appointment to the Sauk River Watershed District Board of Managers. The appointment would be to serve the remainder of a three year term ending on June 30, 2014. Chairman Mitchell called the meeting to order at 8:02 p.m.  Members Mitchell, Pfeffer, Rasmussen, Schuster, Abel, Thompson, Lauer were present.  Student representative Kluver was present.  Superintendent Brooks and a couple visitors were also present.

Lauer moved Thompson seconded to approve the agenda as presented.  Ayes:  All.

Brooks introduced Jackie Knowles with the District’s auditing firm, of Kern, DeWinter, and Viere (KDV).  Knowles led the Board through a presentation of the 2013 fiscal audit, with Brooks also addressing various elements of the audit.

Schuster moved Abel seconded to approve and accept the 2013 fiscal audit as presented.  Ayes:  All.

Thompson moved Lauer seconded to authorize the administration to negotiate and enter into a letter of engagement for the 2014 fiscal audit with KDV.  Ayes:  All.

Brooks reported on a number of items including:

- outdoor facility improvement project;

- planning process/steering committee;

- referendum renewal election process; and

- enrollment data.

Following review and discussion Schuster moved Thompson seconded, to approve the consent agenda as follows:

- Approve the minutes of October 15, 2013;

Resolution to Amend Flexible Benefit Plan

WEREAS, the Employer currently maintains a cafeteria plan pursuant to the requirements of Section 125 of the Internal Revenue Code called the I.S.D. #0743 Flexible Benefits Plan (the Plan), which provides for premium conversion benefits, health care reimbursement benefits and dependent care benefits; and

WHEREAS, the Employer wishes to amend the Plan to conform the definition of “spouse” in Article II, paragraph 2.43 to be applied consistent with the applicable regulatory guidance, including IRS Revenue Ruling 2013-17.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Directors hereby approves this Resolution and amends the employer’s Flexible Benefits Plan and its component parts, such change is effective as of September 16, 2013.

BE IT FURTHER RESOLVED, that the appropriate designees of the Employer are hereby authorized and directed to execute and deliver all documents necessary for the proper implementation of the Plan to ensure that the amended restated Plan, hereby approved is in effect.

- Acknowledge and approve the 2012-2013 Annual Report on Instruction, Technology, Curriculum, and Student Performance.

Brooks reported on the upcoming annual MSBA Leadership Conference.

Member Abel moved the adoption of the following resolution:

RESOLUTION CANVASSING RETURNS

OF VOTES OF SCHOOL DISTRICT SPECIAL ELECTION

BE IT RESOLVED by the School Board of Independent School District No. 743, State of Minnesota, as follows:

1. It is hereby found, determined and declared that the special election of the voters of this school district held on November 5, 2013, was in all respects duly and legally called and held.

2. As specified in the attached Abstract and Return of Votes Cast, at said election a total of 856 voters of the school district voted on the question of renewing the referendum revenue authorization of the school district for taxes payable in 2015 and thereafter (SCHOOL DISTRICT BALLOT QUESTION 1), of which 615 voted in favor, 241 voted against the same, and there were 0 completely blank or defective ballots.  Said proposition, having received the approval of at least a majority of such votes, is hereby declared to have carried.

3. The clerk is hereby directed to certify the results of the election to the county auditors of each county in which the school district is located in whole or in part.  The clerk is also directed to report the results of the referendum revenue authorization election to the Commissioner of Education within fifteen (15) days of the date hereof.

The motion for the adoption of the foregoing resolution was duly seconded by Member Schuster and upon vote being taken thereon, the following voted in favor thereof:  Abel, Mitchell, Pfeffer, Rasmussen, Schuster, Thompson and the following voted against the same:  None whereupon said resolution was declared duly passed and adopted.

1.1 NOTICE TO CONTRACTORS

Sealed Bid Proposals for the furnishing of all labor, materials and all other items necessary to complete the work described herewith, will be received by Sauk River Watershed District at its office located at 524 4th St. S, Sauk Centre, MN, until 11:00AM December 16, 2013, at which time such bids will be opened and read aloud.  The work, in accordance with drawings and specifications prepared by Wenck Associates, Inc. consists of the following major items of work:

Approximately 22,000 LF of ditch cleaning including excavation, grubbing, vegetation removal, and disposal of materials

Approximately 900 LF of ditch cleaning including vegetation and brush removal only

Approximately 500 SY of Class II Riprap at existing drain tile outlets (including geotextile underlayment

Buffer Establishment, Site Restoration and Erosion Control

Each bid proposal shall be accompanied by a “Bid Security” in the form of a certified or cashier’s check made payable to Sauk River Watershed District (“OWNER”) in an amount not less than five percent (5%) of the total bid, or a surety bond in the same amount, running to the OWNER, with a surety company duly authorized to do business in the state of Minnesota, such Bid Security to be a guarantee that the bidder, if awarded a contract, will enter into a contract with Sauk River Watershed District; and the amount of the certified check will be retained or the bond enforced by the OWNER in case the bidder fails to do so.  The OWNER will retain the deposits for the three lowest bidders until the contract has been awarded and executed but not longer than sixty (60) days.  No bid may be withdrawn for a period of sixty (60) days following the bid opening.
