AN ORDINANCE PROVIDING A MORATORIUM ON THE SALE OF HEMP DERIVED THC (TETRAHYDROCANNABINOLS) FOOD AND BEVERAGES IN THE

 CITY OF SAUK CENTRE MINNESOTA



THE CITY COUNCIL OF THE CITY OF SAUK CENTRE, STEARNS COUNTY, MINNESOTA HEREBY ORDAINS:

SUBDIVISION 1.  PURPOSE

This Ordinance establishes a moratorium on the sale of Hemp derived THC (tetrahydrocannabinols) food and beverages in order to allow the city time to study the issue and consider licensing, rules and regulations, and sale management controls for the sale of hemp derived THC food and beverages.

SUBDIVISION 2: RESTRICTIONS

For the period of one year from the effective date of this Ordinance, no sale of hemp derived THC (tetrahydrocannabinols) food or beverages is allowed in the City of Sauk Centre, Minnesota.  The City Council reserves the right to extend this moratorium for such additional periods as are necessary to complete the study as allowed by state law.

ORDINANCE NO. 814

AN ORDINANCE ESTABLISHING A ONE-YEAR MORATORIUM ON SHORT-TERM RENTALS AND THE LIKE WITHIN THE CITY OF SAUK CENTRE



THE CITY COUNCIL OF THE CITY OF SAUK CENTRE HEREBY ORDAINS AS FOLLOWS 

Section 1.  Recitals and Purpose.

A. The City of Sauk Centre (the City) is engaged in a study for the purpose of updating its official controls as defined in Minnesota Statutes, Section 462.352, Subd. 15.

B. The City’s said study will address the advisability and potential amendment of its comprehensive plan and official controls, regarding short-term rentals within the City. 

C. It is the purpose of this ordinance to impose a one-year moratorium on allowing short-term rentals in the City, to protect the City’s planning process by allowing for the completion of studies relating to the development of appropriate land use regulations to regulate short-term rentals in the City.  Such a moratorium is necessary to prevent the location and use of short-term rentals in the City which would have or could have deleterious effects on the City’s planning process and the health, safety and welfare of its citizens. 

Section 2.  Findings of Fact.   The Sauk Centre City Council finds that the following facts exist:

1. The City recognized there are some uses which are deemed to be detrimental to the City’s planning process. Due to their very nature, they may have serious objectionable characteristics and may not be compatible with the comprehensive plan, adjacent uses, or appropriate for location within the city. Special regulation of some uses is necessary to ensure that these adverse effects will not contribute to blight or downgrading of the value of surrounding properties, and to protect the health, welfare and safety of the public in general.

2. The City’s comprehensive plan and official controls are not adequate to protect the economic, environmental and aesthetic qualities of the city from the location and use of short-term rentals in the City.  The City’s current ordinance is limited and inadequate in addressing short-term rentals.

4. All existing short-term rentals will be allowed to continue and additionally be allowed to seek an Interim Use Permit or license as necessary.

5. The City is experiencing a shortage of available housing units, including a shortage of long-term rentals.

Section 3.  Moratorium. In consideration of the foregoing, there is hereby enacted and placed into effect a moratorium from the effective date of this ordinance until one-year thereafter upon the location and use of short-term rentals in the City.

This ordinance shall also have the effect of a moratorium during said one-year period on the City’s issuance of any zoning or other permit or authorization in connection with any plan or application that involve the location or use into the City of short-term rentals.  This moratorium may be extended as provided by law until completion of the City’s study and enactment of a permanent ordinance.  

This ordinance supersedes all contrary or inconsistent terms and provisions of the City of Sauk Centre Code and any existing ordinance of the City. 

Section 4. This ordinance shall be effective immediately upon its passage and publication.
